These Terms constitute a legally binding agreement between you and Elite Essence LLC, operating as Truly Fem, and apply to all users, customers, and subscribers.

We shall not be liable for any modification, suspension, discontinuation, price adjustment, or withdrawal of any product or Service.

5. Products and Services

Certain products and Services may be available exclusively through our website and may be offered in limited quantities.

All returns, exchanges, and refunds are subject to our Refund & Returns Policy available on www.trulyfem.com.

We make reasonable efforts to display product descriptions, images, packaging, colors, and specifications as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect actual product appearance.

We reserve the right to:

6. Subscription, Automatic Billing & Cancellation

Truly Fem offers both one-time purchases and recurring subscription options.

By enrolling in a subscription program, you authorize Truly Fem to automatically charge your selected payment method at the frequency chosen during checkout until the subscription is cancelled.

Subscription Billing

Subscription orders will automatically renew according to the schedule selected by the Customer at checkout.

Future shipments will be processed and billed using the payment method on file unless cancelled before the next renewal date.

Where required by law, we will provide advance notice of upcoming recurring charges and any material changes to subscription pricing.

Cancellation

Customers may cancel their subscription at any time through their customer account portal or by contacting support@trulyfem.com.

To avoid being charged for an upcoming shipment, cancellation requests should be submitted at least twenty-four (24) hours before the next scheduled billing date.

Cancellation will prevent future renewals but will not affect any order that has already been processed or shipped.

Failed Payments

If a recurring payment cannot be processed, we may attempt to notify you and request updated payment information.

We reserve the right to suspend, pause, or terminate subscriptions where payment remains outstanding.

7. Accuracy of Billing and Account Information

Truly Fem strives to ensure that all transactions are processed accurately and securely. We reserve the right to refuse, cancel, or limit any order that appears fraudulent, unauthorized, or unusually large.

If we modify or cancel an order, we may attempt to notify you using the email address, billing address, or telephone number provided at the time of purchase.

You agree to provide current, complete, and accurate billing, shipping, and account information for all purchases made through the Site. You are responsible for promptly updating your information to ensure successful order processing and communication.

11. Subscription Management

Customers may manage, modify, pause, skip, or cancel subscriptions through their customer account portal or by contacting support@trulyfem.com.

Subscription changes become effective for future billing cycles and do not affect orders that have already been processed or shipped.

12. Errors, Inaccuracies, and Omissions

Occasionally, information on the Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping information, availability, or other content.

Truly Fem reserves the right to correct any errors, inaccuracies, or omissions and to modify, update, or cancel orders if information is found to be inaccurate at any time without prior notice.

If an error materially affects an order, we may cancel the order and provide an appropriate refund.

Where liability cannot be excluded, Truly Fem's total liability shall not exceed the greater of:

  • The amount paid by you to Truly Fem during the three (3) months preceding the event giving rise to the claim; or

  • One hundred U.S. dollars (US $100).

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Elite Essence LLC, Truly Fem, and their affiliates, officers, directors, employees, contractors, licensors, suppliers, and service providers from any claim, liability, loss, expense, damage, or demand arising from:

  • Your violation of these Terms;

  • Your misuse of the Services;

  • Your violation of applicable laws; or

  • Your infringement of third-party rights.

17. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

18. Termination

These Terms remain effective unless terminated by either you or Truly Fem.

We reserve the right to terminate or suspend access to the Services at any time if we reasonably believe that you have violated these Terms.

Any obligations incurred before termination shall survive termination where appropriate.

19. Entire Agreement

These Terms, together with any policies and legal notices published on the Site, constitute the entire agreement between you and Truly Fem regarding your use of the Services.

They supersede all prior agreements, communications, proposals, and understandings, whether written or oral.

20. Governing Law

These Terms of Service and any separate agreements whereby Truly Fem provides products or Services shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of law principles.

Nothing in these Terms shall limit any mandatory consumer rights available under the laws of your country, state, or jurisdiction of residence.

21. Dispute Resolution and Arbitration

We encourage customers to contact support@trulyfem.com before initiating formal legal proceedings.

Any dispute arising out of or relating to these Terms, the Site, or the Services shall first be addressed through good-faith efforts to resolve the matter informally.

For U.S. customers, unresolved disputes may be submitted to binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

Arbitration shall be conducted on an individual basis and not as a class action, representative action, or consolidated proceeding.

Each party waives the right to a jury trial to the fullest extent permitted by law.

This provision does not prevent either party from bringing an eligible claim in a small claims court of competent jurisdiction.

For consumers residing outside the United States, including the United Kingdom and European Union, nothing in this section limits any mandatory consumer rights or protections available under applicable law.
